Wills & Estate Planning

It is so important that everyone has valid Wills & Estate Planning in place.  We are able to draft a Will which reflects our clients wishes and deals with the distribution of their assets how they want them to be dealt with following their death. The process we have in place is as simple as possible because we understand that it is not something anyone looks forward to doing. will and estate planning at oxley lawWe also prepare for clients related Estate Planning documents, including Enduring Power of Attorney and Appointment of Enduring Guardian(s). When preparing estate planning documents, we meet with you (either in our office or over the phone) to take initial instructions from you and provide you with information and advice for further consideration.  In most circumstances, we then draft the Will, Enduring Power of Attorney and Appointment of Enduring Guardian documents based on our initial meeting.  From that point, we engage in discussions with you to refine the documents if required and lastly arrange for execution of the documents in order that they are valid.  We store those documents in our Safe Custody.

Estates

Estates is often also referred to as Probate.  We assist clients who are Executors under a Will to apply for and obtain a Grant of Probate from the Supreme Court of NSW. The process of obtaining a Grant of Probate involves the Executor obtaining the original Death Certificate for the deceased person. We then assist with preparing an Inventory of Assets. This is then used as part of the application for a Grant of Probate. Once a Grant of Probate is obtained, we assist clients with the administration of the Estate.  This part of the probate involves writing to all of the asset holders to call in the assets. Once this is done they are distributed in accordance with the terms of the Will.
